Terms and Conditions
Translation of the German original; in the event of any discrepancy, the German version prevails.

1. Scope and provider
These Terms and Conditions apply to all orders placed through lebendigeweine.ch. The provider and contracting party is Taits UG (haftungsbeschränkt), Konrad-Wolf-Strasse 72, 13055 Berlin, Deutschland (hereinafter “we”). We deliver exclusively to delivery addresses in Switzerland and Liechtenstein. You may order as a consumer or as a business; for businesses, the deviations set out in clause 12 apply.
2. Conclusion of the contract
The presentation of the wines in the shop is a non-binding online catalogue, not an offer. By completing your order at the checkout you make a binding offer to buy the wines in your basket; before you submit it you can check and correct all entries. We accept the offer by sending you the order confirmation by e-mail once payment has been received; the contract of sale comes into effect with that confirmation. If, contrary to expectations, an ordered wine is no longer available, we will inform you immediately and refund any payment already made in full.
The language of the contract is German; the English, French and Italian versions of the shop are a service translation. We store the text of the contract (order data and these Terms and Conditions) and send you the order data with the order confirmation; your orders can be viewed at any time in your customer account.
3. Prices
All prices are in Swiss francs (CHF) and include customs duty and all import charges (import tax, clearance). Delivery to your address in Switzerland or Liechtenstein costs a flat CHF 15; orders of 12 bottles or more, or of CHF 300 or more, are delivered free of charge. Nothing further is due on delivery. The price applicable is the one in force at the time of the order. Limited offers are valid for as long as they are shown in the shop and while stocks last.
We ship from Germany as an export delivery; as the importer we pay the Swiss import tax and the customs duties. Swiss value added tax (VAT) is not shown separately on the invoice.
4. Minimum order quantity, maximum quantity and shipping costs
The minimum order quantity is 6 bottles, freely mixed; we deliver up to 12 bottles per order (magnum bottles count double). Shipping costs a flat CHF 15.00 and is waived from 12 bottles or from an order value of CHF 300.00. The shipping costs are shown in the basket and at the checkout.
5. Payment
You pay when ordering with TWINT or by credit or debit card; the payment is processed by our payment service provider Stripe. You receive the invoice electronically with the shipping confirmation as soon as your consignment is on its way; it is then also available in your customer account. The wines delivered remain our property until payment has been made in full.
6. Delivery
We deliver with DHL Express, customs cleared and taxes paid, to your door. The consignment usually leaves our warehouse in Germany within two working days of receipt of payment; delivery in Switzerland usually takes place three to five working days after the order. In extreme heat or frost we briefly hold the shipment back to protect the wines and inform you accordingly. Alcoholic beverages are handed over in person only – they are not left at the door and not handed to neighbours; the courier checks the recipient’s age. If nobody is there, DHL leaves a notification for a second delivery attempt or for collection.
Please check the consignment on receipt. Please report transport damage (breakage, leakage) to us within three days with a photograph by e-mail to ciao@lebendigeweine.ch; we will replace the bottles concerned or refund the purchase price.
7. Protection of minors
We do not sell alcoholic beverages to persons under 18. By placing an order you confirm that you are at least 18 years old. Age is checked on delivery; handover to minors is excluded. If the consignment cannot be delivered for this reason, clause 9 applies.
8. Returns
Swiss law provides no statutory right of withdrawal for purchases made online. We grant you a voluntary right of return: you may return unopened bottles within 14 days of receipt without giving reasons. To do so, contact us by e-mail to ciao@lebendigeweine.ch, quoting the order number; we will agree the procedure with you. Because a return shipment into the EU involves considerable customs formalities, we usually refund the purchase price of the bottles concerned without a return shipment, or we collect the wines from you; please do not send anything back without prior arrangement. The refund is made within 14 days to the means of payment originally used. Opened bottles and wines whose condition has been impaired by improper storage are excluded from return. Your statutory warranty rights (clause 10) remain unaffected.
9. Refusal of acceptance and failed delivery
If you refuse to accept the consignment, or if it cannot be delivered for reasons within your sphere of responsibility (for example missing proof of age, wrong address), you bear the additional costs incurred by the transport service provider as a result (return transport, storage and, where applicable, destruction). We refund the value of the goods less those costs actually incurred.
10. Warranty
The statutory warranty rights apply. Wine is a natural product: sediment, tartrate crystals or a colour appropriate to the age of the wine are not defects. We replace faulty bottles (cork taint, for example) or refund the purchase price; please contact us at ciao@lebendigeweine.ch with a short description. Where a complaint is justified, we bear the costs of dealing with it.
11. Data protection
How we handle your data is described in our Privacy Policy.
12. Applicable law and place of jurisdiction
For consumers domiciled in Switzerland, Swiss law applies; for consumers domiciled in Liechtenstein, Liechtenstein law applies; the place of jurisdiction is your domicile. Mandatory provisions for your protection remain applicable in every case. In all other respects – in particular vis-à-vis businesses – German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods, and the place of jurisdiction is Berlin. The following deviations also apply vis-à-vis businesses: no voluntary right of return under clause 8; period for giving notice of apparent defects three working days after receipt.
13. Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, please contact ciao@lebendigeweine.ch first – as a rule we find a solution.
