This statement describes which personal data we process when you visit lebendigeweine.ch and when you place an order. The EU General Data Protection Regulation (GDPR) applies, as does the Federal Act on Data Protection (FADP) for persons in Switzerland.
2. What data we process and for what purpose
- Order and contract: name, delivery and billing address, e-mail address, telephone number (for the delivery), wines ordered, prices, means of payment and payment status, invoices. Purpose: performance of the contract of sale, shipping, customs clearance, invoicing, customer service. Legal basis: performance of a contract (Art. 6(1)(b) GDPR); statutory retention obligations (Art. 6(1)(c) GDPR).
- Customer account: sign-in without a password, via a link that we send to your e-mail address. We store your e-mail address, order history, addresses and wishlist. Purpose: account functions. Legal basis: performance of a contract.
- Newsletter (“Weinbrief”): e-mail address and chosen language; sign-up only with confirmation by click (double opt-in), for which we store the time of sign-up and of confirmation. You can unsubscribe at any time via the link in every issue. Legal basis: consent (Art. 6(1)(a) GDPR).
- Back-in-stock notification: e-mail address and the wine requested, until the message has been sent. Legal basis: consent.
- Technical access data: IP address, time, page called up, browser type – in the logs of our operator Cloudflare, stored for a short period. Purpose: delivery of the page, security, troubleshooting. Legal basis: legitimate interest (Art. 6(1)(f) GDPR).
- Search: search text and filters are processed in order to return results; we do not link search queries to your customer account.
3. Cookies and local storage
We use only technically necessary cookies: one for your basket and – after you have signed in – one for your customer account session. We do not use tracking cookies, advertising networks or social media plug-ins; a cookie banner is therefore not required. Recently viewed wines are held only in your browser’s local storage and are not transmitted to us; we store your wishlist in your customer account. For audience measurement we use Cloudflare Web Analytics, which works without cookies and without cross-device identifiers.
4. Recipients and processors
We pass data on only in so far as this is necessary for processing the order or a statutory obligation exists:
- Cloudflare, Inc. (USA/EU) – operation of the shop, database, storage, dispatch of our transactional e-mails, bot protection (Turnstile). Transfer on the basis of the EU-U.S. Data Privacy Framework or standard contractual clauses; the Swiss-U.S. Data Privacy Framework applies accordingly.
- Stripe Payments Europe Ltd. (Ireland) – payment processing by card and TWINT (TWINT AG, Switzerland). You enter your card details directly with Stripe; we receive only the payment status and a reference.
- DHL Express (Germany/Switzerland) – transport and delivery; receives name, delivery address, e-mail and telephone number for delivery notifications. For customs clearance, DHL transmits recipient data and details of the goods to the Swiss Federal Office for Customs and Border Security (FOCBS).
- Logistics partner in Germany – some of the wines are shipped directly from our logistics partner’s warehouse; for this purpose the partner receives name and delivery address.
- Haufe-Lexware GmbH & Co. KG (Germany, Lexware Office) – accounting: invoice and payment data.
- Hetzner Online GmbH (Germany) – search server for the product search.
5. Retention
We keep order and invoice data for ten years (commercial and tax law obligations in Germany; Art. 958f Swiss Code of Obligations). After you unsubscribe from the newsletter, we keep only your e-mail address together with the times of sign-up, confirmation and unsubscription, as evidence and as a block notice so that you receive no further issues; we delete this information three years after you unsubscribe. We delete account data on request after the account has been deleted, in so far as no retention obligation stands in the way. Technical logs are deleted automatically after a short time.
6. Your rights
You have the right to information about your data, to rectification, erasure and restriction of processing, to data portability and to object to processing based on legitimate interests (Art. 15–21 GDPR; Art. 25 et seq. FADP). You may withdraw consent you have given at any time. To do so, please contact ciao@lebendigeweine.ch. In your customer account you can also view and export your data yourself.
You can lodge a complaint with a data protection supervisory authority; the authority responsible for us is the Berlin Commissioner for Data Protection and Freedom of Information. Persons in Switzerland can also contact the Federal Data Protection and Information Commissioner (FDPIC).
7. Security
The connection to the shop is encrypted (TLS). Payment data is not stored on our systems. Access to customer data is restricted to the persons who need it for processing.
8. Changes
We adapt this statement when our data processing changes. The version published here at any given time applies.
